Today, we are unpacking the Hunter Biden gun trial after the prosecution rested its case on Friday.

Hunter Biden is accused of 3 felony gun charges; two counts of making false statements and one count of illegal possession that could add up to 25 years in prison. According to prosecutors, Hunter Biden illegally purchased and possessed a gun while he was addicted to crack cocaine. Federal law prohibits users of illegal drugs from owning firearms, and he has pleaded not guilty to all charges.

Allegedly, Hunter lied about his drug use on a federal form when he bought a revolver in October of 2018, a period in which, according to his memoir, he was actively abusing drugs. He owned the gun for 11 days before his then-partner, Hallie Biden, found it and threw it in the trash outside of a grocery store.

For prosecutors to convict the young Biden, they have to prove that he knowingly made false statements on the application to deceive the store into selling him a gun. They also have to convince jurors that Hunter was a drug user at the time, though this hasn’t proven to be too difficult a task. The leather pouch containing Hunter’s revolver tested positive for cocaine, and the jury was shown text messages between him and drug dealers, as well as photos of him holding crack pipes. All in all, not a good look for the Bidens.

The defense seeks to prove that Hunter didn’t see himself as an addict at the time he bought the gun, and didn’t seek to deceive anyone. As for his 2021 memoir where he discusses being an addict during the time he owned the gun, they argue that he realized his addiction in hindsight, but was in denial at the time of the crime.

As of this weekend, the prosecution is at rest and the defense will take the stand in the first ever criminal trial of a standing president’s child. Joe and Jill Biden attended court several times last week in support of their son, however, Biden said he will not issue a pardon if Hunter is convicted.
